Immo may be off in the ecu however the pairing between the cluster and the key is now different hence why the immo is active. What car are you dealing with? I am imagining 2006 and newer?

It's a 2006 vw Jetta 2.0 tfsi I just swapped the chip part of the key fob in to the new key and car is now running. So the key and cluster have to match no matter what even with immo off ecu

To my knowledge the immo system extends past the ecu in your car.  Where, even if the ecu is defeated there will still be a road block if the cluster and key don't match each other.
